The Division of Guardian and Advocacy's Administrative Hearings Unit requires licensed mediators to provide mediation services concerning child welfare issues. These mediators are present at an administrative hearing if requested. There are several risks if the state chooses not to approve this contract: the Department risks having to spend more time and money to go to a fair hearing each time a mutual agreement cannot be made; fair hearings cost the state more money than mediation services, as fair hearings involve Department representatives, clients, witnesses, court reporters, etc. and the costs that go along with having all of these individuals present at the hearings; we also risk not providing them with reasonable alternatives for conflict resolution. Mediation services provide participants with an equal opportunity to express their needs and interests as related to the case.
